Per aix\u00f2, malgrat el seu embar\u00e0s, una treballadora pot ser acomiadada si es demostren els motius que justifiquen l&#039;acomiadament. I qu\u00e8 passa si l&#039;empresari no els pot demostrar? En aquest cas la treballadora podr\u00e0 exigir-ne la readmissi\u00f3 per la nul\u00b7litat del seu acomiadament.<\/p>\n<p>Amb car\u00e0cter general, a Espanya es podria dir que a la pr\u00e0ctica hi ha \u201cl&#039;acomiadament lliure, pagant\u201d, ja que l&#039;empresari pot acomiadar un treballador sense causa justificada, o existint motius, sense poder demostrar-los. Tot i aix\u00ed, podr\u00e0 acomiadar el treballador pagant-li la indemnitzaci\u00f3 corresponent a un acomiadament improcedent.<\/p>\n<p>La llei no pot evitar aquest tipus d&#039;acomiadaments \u201clliures\u201d, que en realitat haurien de ser causals, \u00e9s a dir, justificats per un motiu adm\u00e8s legalment, ja que nom\u00e9s quan darrere de l&#039;acomiadament hi ha un motiu de discriminaci\u00f3 o violaci\u00f3 dels drets fonamentals, l&#039;acomiadament ser\u00e0 declarat nul pel jutjat i l&#039;empresari haur\u00e0 de readmetre al treballador.<\/p>\n<p>Els antecedents d&#039;aquesta sent\u00e8ncia recent del TJUE de 22.02.2018 s\u00f3n els seg\u00fcents:<\/p>\n<p>Al gener del 2013 una entitat financera va iniciar un proc\u00e9s d&#039;acomiadament col\u00b7lectiu per causes econ\u00f2miques que va finalitzar amb acord amb la representaci\u00f3 legal dels treballadors.<\/p>\n<p>En aquest acord es van concretar els criteris objectius que l&#039;empresa seguiria per designar els empleats afectats per l&#039;acomiadament i, aix\u00ed mateix, s&#039;identificaven els col\u00b7lectius que tindrien prioritat per romandre a la companyia, entre els quals no hi havia les treballadores embarassades.<\/p>\n<p>El novembre del 2013 la companyia va acomiadar una empleada en situaci\u00f3 d&#039;embar\u00e0s detallant a la carta d&#039;acomiadament la necessitat d&#039;articular acomiadaments for\u00e7osos a la prov\u00edncia de Barcelona on prestava serveis i la baixa valoraci\u00f3 obtinguda en el proc\u00e9s d&#039;avaluaci\u00f3 efectuat a l&#039;entitat. Tot aix\u00f2, d&#039;acord amb els criteris d&#039;afectaci\u00f3 pactats a l&#039;acord col\u00b7lectiu.<\/p>\n<p>La treballadora va interposar demanda davant els jutjats de Mataro per acomiadament, la qual va ser desestimada en primera inst\u00e0ncia. Aquesta demanda va ser objecte de recurs davant del Tribunal Superior de Just\u00edcia de Catalunya, que va plantejar q\u00fcesti\u00f3 prejudicial al Tribunal Superior de Just\u00edcia de la Uni\u00f3 Europea, i que ha estat resolta en la sent\u00e8ncia.<\/p>\n<p>La Directiva Europea 92\/85 fa refer\u00e8ncia a l&#039;aplicaci\u00f3 de mesures per promoure la millora de la seguretat i de la salut en el treball de la treballadora embarassada. Aleshores cal preguntar-se si la norma espanyola \u00e9s d&#039;acord amb aquesta en permetre l&#039;acomiadament d&#039;una treballadora embarassada en un acomiadament col\u00b7lectiu. I la resposta \u00e9s S\u00ed, ja que la Directiva prohibeix acomiadar una embarassada, llevat de casos excepcionals no inherents al seu estat, i un acomiadament col\u00b7lectiu constitueix un cas excepcional.<\/p>\n<p>Per\u00f2 cal no oblidar que l&#039;empresa ha de justificar per escrit a la carta d&#039;acomiadament, les causes concretes que el motiven. Aquestes causes poden ser econ\u00f2miques, t\u00e8cniques, organitzatives o de producci\u00f3 de lempresa. No s&#039;exigeix, per tant, fer cap refer\u00e8ncia a la concurr\u00e8ncia d&#039;un sup\u00f2sit excepcional. En qualsevol cas, l&#039;entitat ha d&#039;expressar els criteris objectius que ha seguit per a l&#039;afectaci\u00f3 de la treballadora embarassada a l&#039;acomiadament col\u00b7lectiu.<\/p>\n<p>Aleshores, la norma espanyola \u00e9s contr\u00e0ria a la Directiva 92\/85, per no establir una prioritat de perman\u00e8ncia a l&#039;empresa de les treballadores embarassades? La resposta \u00e9s No. La Directiva obliga els Estats membres a prendre les mesures necess\u00e0ries per prohibir l&#039;acomiadament de les treballadores durant el per\u00edode compr\u00e8s entre el comen\u00e7ament del seu embar\u00e0s i el final del perm\u00eds de maternitat, per\u00f2 aquesta obligaci\u00f3 no compr\u00e8n el deure d&#039;establir una prioritat de perman\u00e8ncia a l&#039;empresa ni una prioritat de recol\u00b7locaci\u00f3 en un altre lloc de treball abans de procedir a l&#039;acomiadament.<\/p>\n<p>No obstant aix\u00f2, la Directiva nom\u00e9s cont\u00e9 disposicions m\u00ednimes, per la qual cosa no exclou la facultat dels Estats membres de garantir una protecci\u00f3 m\u00e9s gran a les treballadores embarassades.
